Your notion of arbitrariness makes no sense under our law. No U.S. court would convict a man for popping a cap at a political entrepreneur trying to kill Jews who hide behind stones and trees. I understand that legal practices differ under the Russian traditions, responsible for enriching the world vocabulary with the term pogrom, and its literary legacy with The Protocols of the Learned Elders of Zion. Different strokes for different folks.
