The essential predicate for a charge of sexual assault of an adult is a lack of consent on part of the victim. Nothing in Charlotte Waters’ original complaint, which has been modestly removed from Reddit, but happily remains available via the Wayback Machine, even begins to allege that she had failed to consent to any sexual act, any photo opportunity, or any other aspect of her modeling encounter with Terry Richardson. Interestingly enough, as any journalist ought to know, actual malice as the essential predicate of liability for libel is defined as “knowledge that the information was false” or that it was published “with reckless disregard of whether it was false or not” (New York Times Co. v. Sullivan, 376 U.S. 254 (1964)). Thus in failing to align his accusation of Terry Richardson with the content of published allegations against the latter, Justin Jones acts with reckless disregard of whether it was false or not, and therefore willfully commits libel on behalf of The Daily Beast.

Please be advised that starting on 27 September 2010, my associates and I will resume open-ended peaceful public protests last held in 2009 in front of NEA, 2855 Sand Hill Road, Menlo Park, CA 94025 and Cisco/WebEx, 3979 Freedom Circle, Santa Clara, CA‎ 95054. The purpose of our demonstrations will be to protest Subrah Iyar’s employment by Cisco/WebEx, Scott Sandell’s employment by NEA, and the association of these individuals and their employers with Min Zhu, as explained at http://www.subrah.com.



My associates and I are pledged to abide by all applicable laws. We exercise our right to free expression on private property readily accessible to general public pursuant to the rulings in Pruneyard Shopping Center v. Robins, 447 U.S. 74 (1980) and progeny. We assert that the strip of private property directly in front of the main entrances to 2855 Sand Hill Road, Menlo Park, CA 94025 and the plaza in front of 3979 Freedom Circle, Santa Clara, CA‎ 95054, both fall within the purview of Pruneyard in virtue of housing several unrelated businesses and being readily accessible to the general public. Additionally, owing to police and hotel management misconduct at our first public protest in San Francisco, and death threats received in the past and recently renewed in the matter at issue, we shall exercise our right to bear arms pursuant to the Second Amendment of the U.S. Constitution and all applicable federal and state laws, by carrying exposed, unloaded firearms, legally owned by my associates and me in the state of California, accompanied by loaded magazines, bandoleers, and speedloaders, subject to the definitions of People v. Clark (1996), 45 Cal.App.4th 1147, 53 Cal.Rptr. 2d 99. None of the firearms in question will qualify as assault weapons under California law, as listed or described in Penal Code Sections 12276, 12276.1, and 12276.5. My associates and I agree to Section 12031(e) inspections of our firearms on demand by police officers. Please note recent incorporation of the Second Amendment protection of the right to keep and bear arms as “fundamental” to the American scheme of ordered liberty, in McDonald v. Chicago, 561 U.S. ___ (2010).

We will not interfere in any unlawful way with the operation of NEA, Cisco/WebEx, or any of their employees, clients, associates, or visitors, including, but not limited to, Subrah Iyar and Scott Sandell. At the same time, we shall vigorously enforce our right to speak out against the knowing collusion of big business in your jurisdictions with a violent child rapist, and seek redress for all wrongs consequently visited upon us, by resisting in all lawful ways and publicly denouncing in all appropriate venues, any private or official attempt to interfere with our rights. Please take note of case law, beginning with Florida v. J.L., 529 U.S. 266 (2000), to the effect that detaining a man observed as openly carrying an unloaded firearm in public violates the Fourth Amendment. Please note further ACLU of Nevada v. City of Las Vegas (ACLU II), 466 F.3d 784, 790 (9th Cir. 2006) and progeny holding various local ordinances prohibiting street expression, solicitation, and entertainment, in violation of the First Amendment. Lastly, please be aware that litigation over infringement of fundamental Constitutional rights is subject to a mandatory award of attorneys’ fees and court costs to the prevailing party intent on exercising them, typically in the amount of a multiple of the actual fees and costs. Our costs in mounting these events are considerable, and we shall seek court orders for their manifold reimbursement by any perpetrators of unlawful interference.

We are pleased to point out that our prior events in San Diego, Milpitas, Menlo Park, and Santa Clara were unmarked by any disturbances. We hope that the same will be the case on this occasion of scaling up our activities within the bounds of legitimacy sanctioned by the authorities of the United States Court of Appeals for the Ninth Circuit and the United States Supreme Court. Owing to substantial gains in our quest for remedies against Min Zhu and his confederates, our protests shall henceforth include topical artistic performances by bagpipers, clowns, rappers, and a brass band. It is our position that these performances are protected under the First Amendment, and therefore are not subject to local permit requirements. However, as an accommodation provided in the spirit of courtesy, we shall abstain from erecting free-standing signs and using amplification equipment, and will consider requests for additional constraints on our performances on a case-by-case basis. Lastly, we continue to claim the right protected by the First Amendment, to hold press conferences at the site of our protests and to film all passerby there being questioned as to their opinion of big business knowingly getting in bed with a violent incestuous paedophile. We hope to forestall futile litigation bound to be costly and disappointing to your taxpayers by giving you this advance notice of our plan.

Tactics means doing what you can with what you have. Tactics are those consciously deliberate acts by which human beings live with each other and deal with the world around them. In the world of give and take, tactics is the art of how to take and how to give. Here our concern is with the tactic of taking; how the Have-Nots can take power away from the Haves.
    For an elementary illustration of tactics, take parts of your face as the point of reference; your eyes, your ears, and your nose. First the eyes; if you have organized a vast, mass-based people’s organization, you can parade it visibly before the enemy and openly show your power. Second the ears; if your organization is small in numbers, then do what Gideon did: conceal the members in the dark but raise a din and clamor that will make the listener believe that your organization numbers many more than it does. Third, the nose; if your organization is too tiny even for noise, stink up the place.
    Always remember the first rule of power tactics:
    Power is not only what you have, but what the enemy thinks you have. [Power has always derived from two main sources, people and money. Lacking money, the Have-Nots must always build power from their own flesh and blood. A mass movement expresses itself with mass tactics. Against the finesse and sophistication of the status quo, the Have-Nots have always had to club their way. In early Renaissance Italy the playing cards showed swords for the nobility (the word spade is a corruption of the Italian word for sword), chalices (which became hearts) for the clergy, diamonds for the merchants, and clubs as the symbol of the peasants.]
    The second rule is: Never go outside the experience of your people. It results in confusion, fear and retreat. It also leads to a collapse in communications.
    The third rule is: Whenever possible go outside of the experience of the enemy. Here you want to cause confusion, fear, and retreat.
    General William T. Sherman, whose name still causes a frenzied reaction throughout the South, provided a classic example of going outside the enemy’s experience. Until Sherman, military tactics and strategies were based on standard patterns. All armies had fronts, rears, flanks, lines of communication, and lines of supply. Military campaigns were aimed at such standard objectives as rolling up the flanks of the enemy army or cutting the lines of supply or lines of communication, or moving around to attack from the rear. When Sherman cut loose on his famous March to the Sea, he had no front or rear lines of supplies or any other lines. He was on the loose and living on the land. The South, confronted with this new form of military invasion, reacted with confusion, panic, terror, and collapse. Sherman swept on to inevitable victory. It was the same tactic that, years later in the early days of World War II, the Nazi Panzer tank divisions emulated in their far-flung sweeps into enemy territory, as did our own General Patton with the American Third Armored Division.
    The fourth rule is: Make the enemy live up to its own book of rules. You can kill them with this, for they can no more obey their own rules than the Christian Church can live up to Christianity.
    The fourth rule carries within it the fifth rule: Ridicule is man’s most potent weapon. It is almost impossible to counteract ridicule. It also infuriates the opposition, who then react to your advantage.
    The sixth rule is: A good tactic is one your people enjoy. [“Alinsky takes the iconoclast’s pleasure in kicking the biggest behinds in town and the sport is not untempting…” —William F. Buckley, Jr., Chicago Daily News, October 19, 1966.] If your people are not having a ball doing it, then there is something very wrong with the tactic.
    The seventh rule: A tactic that drags on too long becomes a drag. Man can sustain militant interest in any issue for only a limited time, after that it becomes a ritualistic commitment, like going to church on Sunday mornings. New issues and crises are always developing, and one’s reaction becomes “Well, my heart bleeds for these people, and I’m all for the boycott, but after all, there are other important things in life”—and there it goes.
    The eighth rule: Keep the pressure on, with different tactics and actions, and utilize all events of the period for your purpose.
    The ninth rule: The threat is usually more terrifying than the thing itself.
    The tenth rule: The major premise for tactics is the development of operations that will maintain a constant pressure upon the opposition. It is this unceasing pressure that results in the reactions from the opposition that are essential for the success of the campaign. It should be remembered not only that the action is in the reaction, but that action is itself the consequence of reaction and of reaction to the reaction, ad infinitum. The pressure produces the reaction, and constant pressure sustains action.
    The eleventh rule is: If you push a negative hard and deep enough it will break through to its counterside; this is based on the principle that every positive has its negative. We have already seen the conversion of the negative into the positive, in Gandhi’s development of the tactic of passive resistance.
    One corporation we organized against responded to the continuous application of pressure by burglarizing my home, and then using the keys taken in the burglary to burglarize the officers of the Industrial Areas Foundation where I work. The panic in this corporation was clear from the nature of the burglaries, for nothing was taken in either burglary to make it seem that the thieves were interested in ordinary loot—they took only the records that applied to the corporation. Even the most amateurish burglar would have had more sense than to do what the private detective agency hired by that corporation did. The police departments in California and Chicago agreed that “the corporation might just as well have left its fingerprints all over the place.”
    In a fight almost anything goes. It almost reaches the point where you stop to apologize if a chance blow lands above the belt. When a corporation bungles like the one that burglarized my home and office, my visible public reaction is shock, horror, and moral outrage. In this case, we let it be known that sooner or later it would be confronted with this crime as well as with a whole series of other derelictions, before a United States Senate Subcommittee Investigation. Once sworn in, with congressional immunity, we would make these actions public. This threat, plus the fact that an attempt on my life had been made in Southern California, had the corporation on a spot where it would be publicly suspect in the event of assassination. At one point I found myself in a thirty-room motel in which every other room was occupied by their security men. This became another devil in the closet to haunt this corporation and to keep the pressure on.

    In conflict tactics there are certain rules that the organizer should always regard as universalities. One is that the opposition must be singled out as the target and “frozen.” By this I mean that in a complex, interrelated, urban society, it becomes increasingly difficult to single out who is to blame for any particular evil. There is a constant, and somewhat legitimate, passing of the buck. In these times of urbanization, complex metropolitan governments, the complexities of major interlocked corporations, and the interlocking of political life between cities and countries and metropolitan authorities, the problem that threatens to loom more and more is that of identifying the enemy. Obviously there is no point to tactics unless one has a target upon which to center the attacks. […]

It should be borne in mind that the target is always trying to shift responsibility to get out of being the target. There is a constant squirming and moving and strategy—purposeful, and malicious at times, other times just for straight self-survival—on the part of the designated target. The forces of change must keep this in mind and pin that target down securely. If an organization permits responsibility to be diffused and distributed in a number of areas, attack becomes impossible. […]

One of the criteria in picking your target is the target’s vulnerability—where do you have the power to start? Furthermore, the target can always say, “Why do you center on me when there are others to blame as well?” When you “freeze the target,” you disregard these arguments and, for the moment, all others to blame.
    Then, as you zero in and freeze your target and carry out your attack, all of the “others” come out of the woodwork very soon. They become visible by their support of the target.
    The other important point in the choosing of a target is that it must be a personification, not something general and abstract such as a community’s segregated practices or a major corporation or City Hall. It is not possible to develop the necessary hostility against, say, City Hall, which after all is a concrete, physical, inanimate structure, or against a corporation, which has no soul or identity, or a public school administration, which again is an inanimate system.

Childhood in much of India begins with the young child being regularly masturbated by the mother, “high caste or low caste, the girl ‘to make her sleep well,’ the boy ‘to make him manly…’” This practice has been said to be widespread by many reliable observers, including Catherine Mayo—whose extensive investigations in India in the 1920s led to the first child marriage laws—a physician, an ethnologist, a religious scholar and a sociologist. The extent to which Indian parents go beyond this and overtly have sex with the child cannot be determined. Rampal, the sociologist who recently did interviews modeled on the Kinsey studies about contemporary Indian sexual practices, concludes that “there is a lot of incest… It is hidden along with other secrets of families and rarely gets a chance to come out, like seduction at the hands of trusted friends of the family… To arrive at even a passable estimate of incest cases would be to touch the hornet’s nest… no one will ever confess to such a deed, therefore, any attempt to collect statistics may prove to be futile at present.”
    Boys as well as girls are reported as being masturbated and raped by the men in the family, including fathers, older brothers, uncles and cousins. By the time children are four or five, they are usually taken to bed at night by others in the extended household. “A particular uncle may like her to sleep in his room, which is considered a great gesture of closeness.” As one girl describes it: “I hardly ever slept with my parents after I was four. I rotated almost every night between my various uncles and sometimes my grandmother. But it was difficult to have any space in her bed because all the grandsons slept in her bed… So I preferred to sleep in [uncle’s] bed, who was very nice and put his arms around me in winter.” This practice is similar to the customary sharing of their wives by brothers, who have free sexual access to each other’s wives, an ancient practice still approved of in some areas in India.
    So acceptable is sex between close relatives in India that uncle-niece and cross-cousin marriages were preferred among certain Indian groups. As the old Indian proverb has it, “For a girl to be a virgin at ten years old, she must have neither brothers nor cousin nor father.” These sleeping patterns with relatives who live in common residences continue even after marriage, since husbands are often cold to wives, and sex with the husband’s younger brother is covertly encouraged by the family to give the wife someone to be “close” to. Grandfathers often call the little girls “my little wife,” give them candy and “play the role of an old seducer,” teasing them by saying “Don’t you want to marry me?” One observer stuns up traditional Indian sexual stimulation during childhood as follows: “The little Hindu girls are deflowered by the little boys with whom they play, and repeat together the erotic lessons which their parents have unwittingly taught them on account of the general promiscuity of family life throughout India. In all the little girls of less than ten years of age the complete hymen is wanting… Incest is often the rule rather than the exception.

Close-knit family life in India masks an alarming amount of sexual abuse of children and teenage girls by family members, a new report suggests.
    Delhi organisation RAHI said 76% of respondents to its survey had been abused when they were children—40% of those by a family member.
    The report suggests that disbelief, denial and cover-up to preserve the family reputation is often put before the individual child.
